DEAR TRAVELERS:

This document constitutes a Framework Contract, through which the provision of services by ALPES TRIPS with its clients will be regulated and that in any case will be integrated with the offers included on the website www.alpestrips.com. Consequently, this document establishes the general conditions for the execution of the services offered and contracted by clients that are specified in the offers selected by them.

 

1. ALPES TRIPS - TOUR OPERATOR AND TRAVEL AGENCY

 

Alpes Trips is a company, legally incorporated in Germany, with VAT number DE 28615477 and tax number 144/184/707. Its main corporate purpose is to create, develop, market, organize and promote tourist plans to be operated by it; operates within Germany tourist plans programmed and organized by itself or by national or foreign travel agencies, provides guidance services and provides specialized teams when the activity so requires. The aforementioned company operates day tours (nature and adventure trips in the Alpine region) for nationals and foreigners.

2.  ACCEPTANCE OF TERMS AND CONDITIONS BY THE CLIENT

By accessing the website and / or any of the services offered by Alpes Trips, it will be considered that the client is fully aware of the content of the offers made by Alpes Trips, and that he knows and is well informed of the conditions of time, mode and place of each one of them at the time of requesting the service. In case of doubt, you should contact Alpes Trips prior to taking any service, at the email tours@alpestrips.com, since once the service is booked, it cannot be canceled or modified unless the exceptions described below apply. . Once the provision of the service by Alpes Trips has been accepted, it will be the exclusive responsibility of the latter to interpret the content of the offers presented on the website with the support of clarifying communications sent at any time to the respective client. In any case, the client declares to expressly accept any contract through which Alpes Trips decides to regulate these terms and conditions. The entry, registration, reservation and purchase through the www.alpestrips.com page is understood as a tacit acceptance of these terms and conditions. By accepting these Terms and Conditions it is presumed that the client is aware of the level of risk involved in the activities offered by Alpes Trips and that they are freely accepted by the client, who assumes full responsibility for the damages caused to himself or herself or third parties during the execution of said activities.

3. REQUIREMENTS TO BE FULFILLED BY THE CLIENT

 

Clients who are not over 18 years of age must be accompanied by their parents, who will sign all the documents on their behalf or by a responsible adult duly authorized in writing by the guardian. However, ALPES TRIPS will require the CLIENT to submit information through the medical file that the CLIENT fills out before any TRIP OR EXPEDITION and certain documents to prove their medical condition and ability to access services, it will be up to the CLIENT to present ALPES TRIPS any additional information that in their opinion is relevant to prove their full capabilities and any relevant medical condition. ALPES TRIPS declares that the only source of information to which it will have access will be that supplied exclusively by the CLIENTS, which it will presume truthful, complete and timely at all times. The lack of accurate, complete and timely information will be considered as grounds for exclusion of responsibility for Alpes Trips. THE CLIENT who contracts a service or trip with ALPES TRIPS must have medical insurance that can cover the expenses for illness, accident or any other situation that may arise during the trip. ALPES TRIPS will require THE CLIENT to have the insurance. By contracting the service with ALPES TRIPS, it is understood that THE CLIENT has said insurance, with sufficient validity and coverage to attend to any situation that arises during the development of the service.

 

4. SERVICES OFFERED THROUGH THE WWW.ALPESTRIPS.COM PAGE

 

Alpes Trips offers the following services through its website: Services marketed and operated exclusively by ALPES TRIPS; Services marketed by ALPES TRIPS, but whose operation will be in charge of THIRD-PARTY operators affiliated with ALPES TRIPS; Services marketed and operated by THIRD PARTIES, where ALPES TRIPS will act as commercial agent and will collaborate with the CLIENT in all procedures with THIRD PARTIES; Services marketed by ALPES TRIPS and operated by ALPES TRIPS in the company of THIRD operators. To access any of the above services, THE CLIENT must request the service of their choice from ALPES TRIPS by filling out and sending the service request forms established by ALPES TRIPS on its website or by mail, telephone call or any means that allows ALPES TRIPS to know the trip desired by THE CLIENT. However, there are trips previously designed by ALPES TRIPS, THE CLIENT may design their trip according to their preferences. For the purposes of this document, THE CLIENT and ALPES TRIPS will understand that there are two kinds of offers: STANDARD OFFERS: These are the offers offered by ALPES TRIPS through its website and on which THE CLIENT accepts the content and the conditions expressly established therein. ADJUSTED OFFERS - TAILOR-MADE TRAVELS: These are the offers that are specifically designed by ALPES TRIPS for a specific interested CUSTOMER, and that exceed, modify or complement the standard offers.

 

5. RESERVATION OF SERVICES

 

To make a reservation for any service, the CLIENT must fill out and send the "RESERVATION FORM" or other "FORMATS" established by ALPES TRIPS on its website and must make an initial payment agreed with ALPES TRIPS, which for all legal purposes , will be considered service orders in favor of ALPES TRIPS. Only the reservation of the service by the CLIENT will be understood to have been perfected, once ALPES TRIPS accepts the service request sent by THE CLIENT and an initial payment of 50% has been made. ALPES TRIPS reserves the right not to accept service orders whose CLIENTS do not comply with the requirements demanded by the company or whenever the service requested by THE CLIENT exceeds in any way the capabilities of ALPES TRIPS.

6. PAYMENT

​

No later than 7 days after receipt of the reservation documents, the traveler must pay the amount of the advance indicated in our account. The reservation and payment of your trip is done in 2 steps:

Step 1: Once the offer is confirmed by both parties, you will receive an email from us with a registration form to summarize all the information necessary for the reservation. You will also receive our bank details to make an advance of 50% of the total price. Payment for round trips and travel components is made by bank transfer to an account in Germany or by means of an online payment link.

Step 2: The deposit and access to the registration form will be confirmed by email. The balance must be paid before departure, after having received all documents, tickets, vouchers and information about the trip. Failure to pay the outstanding amount at the time of departure will be considered an unannounced cancellation by the client.

 

7. CANCELLATION OR RE-PLANNING OF THE SERVICE BY THE CLIENT

 

In the event of any modification or cancellation of the reservation by the CLIENT, ALPES TRIPS will apply the cancellation rules defined for each of the services, which will be included in each offer. In the event that the cancellation conditions are not defined in the offers, the following rules will be applied subsidiarily: For cancellation of the service, the cancellation policies corresponding to the service reserved and purchased by the CLIENT will be applied, which can be found in the cancellation policies section (below). ALPES TRIPS will not be obliged to reimburse the CUSTOMER any sum if for reasons beyond ALPES TRIPS the CUSTOMER does not show up in a timely manner at the place where the service began or arrives after the start of the service (eg delay or loss of flights, illness, problems on the tracks, or any other situation that prevents reaching the agreed meeting point, at the agreed time). Notwithstanding the foregoing, ALPES TRIPS reserves the option to make the reimbursements it considers, but is not obliged, in the event that the cancellation of the trip by the CLIENT is due to personal reasons or force majeure. It is suggested to establish service cancellation policies. If the CLIENT cancels the service with more than 30 days in advance, and wishes to postpone the date of the same, you can use the previous reservation for another service at any time, without losing the deposit. The new reservation will be subject to availability and the conditions given by ALPES TRIPS.

8. CANCELLATION POLICIES BY THE CLIENT (PENALTY)

 

Up to 4 weeks before departure: 0%.

3 weeks before departure: 5%.

2 weeks before departure: 10%.

1 week before departure 15%

from 2 days (48 hours) before departure: 90%.

 

9. CANCELLATION AND / OR MODIFICATIONS OF THE TRIPS BY ALPES TRIPS BEFORE THE START OF THE SAME

 

When the services are subject to a minimum number of participants and so has been communicated to THE CLIENT, if with 3 (three) days before the start of the service, the minimum number of reservations required for the start of the service has not been confirmed, ALPES TRIPS may unilaterally cancel the execution of the service. In this case, ALPES TRIPS will inform the CLIENT and refund 100% of the amount paid. Notwithstanding the foregoing, ALPES TRIPS may offer customers the option of making an additional payment to compensate for the low number of participants to develop the service as planned. If there is no agreement of all the clients to make the additional payment, a new reservation can be made in a different service, paying the value of the initial reservation or requesting a refund of 100% paid. ALPES TRIPS will not be responsible for any previous cost assumed by THE CLIENT such as hotels, tickets, transportation, etc. Therefore, it is recommended to establish trip cancellation insurance. Faced with a situation that is considered force majeure and / or fortuitous event, due to the fact of a third party or due to the improper use of the client, ALPES TRIPS may modify the conditions offered at the beginning, or may cancel any of the TRAVELS offered (before the start of the trip or during it). ALPES TRIPS may modify the offers published on the page in any way, without prior notice, in the event of situations beyond its control that require it, such as sudden alteration of the state of the roads, increased costs. , weather conditions, closure of National Parks, Reserves or any public space and other external factors that could limit the services offered. You may also modify the offer in any way due to security situations that warrant it, prior to the beginning of the execution of the service or during the execution thereof. This will not constitute a breach by ALPES TRIPS. In any case, ALPES TRIPS guarantees that the new conditions will maintain the standards initially offered. If the trip is canceled before it has started, only due to force majeure, acts of God or a third party, ALPES TRIPS may retain 20% of the value paid by THE CLIENT. In the event of cancellation by ALPES TRIPS, once the trip has started, due to force majeure, acts of God or act of a third party or improper use of the client, ALPES TRIPS will only return the costs of the services that have not been executed. In any case, ALPES TRIPS should not assume the additional costs that THE CLIENT has incurred. ALPES TRIPS may modify the offers published on the page in any way, without prior notice, in the event of situations beyond its control that require it, such as sudden alteration of the state of the roads, increased costs. , weather conditions, closure of National Parks, Reserves or any public space and other external factors that could limit the services offered. You may also modify the offer in any way due to security situations that warrant it, prior to the beginning of the execution of the service or during the execution thereof. 10. CANCELLATION AND / OR MODIFICATIONS OF THE CONDITIONS OF THE TRAVEL BY ALPES TRIPS AFTER THE START

 

ALPES TRIPS may cancel the service after it begins and retain the equipment delivered to the CLIENT in the event that the latter does not comply with the safety and use regulations provided by ALPES TRIPS for the respective service, or whenever the CLIENT violates the laws of traffic, consume alcohol, by physical or psychological aggressions to the members of the trip or to third parties, or when their behavior is dangerous, reckless and / or represents a risk for them or the people accompanying them. In this case, THE CLIENT must compensate ALPES TRIPS for the losses suffered and the additional costs that arise, such as early return of equipment and vehicles, hotels, meals, etc. ALPES TRIPS will not have to make any refund of the CUSTOMER SERVICE payment. ALPES TRIPS may modify any of the conditions for the execution of the contracted services whenever situations arise beyond its control that require it; including but not limited to: acts of civil disorder; including war, blockades, insurrections, riots, mass protests, and actions of the military forces related to or in response to any act of civil disorder, acts, or absence of acts, of the Government and of the Legislative and Judicial branches including laws, orders, regulations, decrees, judgments, legal actions, regulations, renewal or confirmation of permits and licenses, which are carried out either by the Government or any Competent Authority on equipment rental activities or high-risk activities, epidemics, landslides , hurricanes, floods, avalanches, lightning, earthquakes, fire, tsunami, disaster in land, air, rail, river and sea transportation sudden alteration of the state of the roads, weather conditions and other external factors that could limit the services offered; without this constituting a breach by ALPES TRIPS. In any case, ALPES TRIPS guarantees that the new conditions will maintain as far as possible the standards initially offered and if it becomes necessary to cancel the trip, ALPES TRIPS is not obliged to reimburse the payment of the service.

 

11. REPLACEMENT OF PARTICIPANT

 

In principle, the change of person is possible without restrictions and free of charge for all tours operated directly by Alpes Trips. Certain changes will be subject to a surcharge according to the cancellation policies and conditions of our affiliates and external service providers. 

 

12. RETURNS

 

In any of the cases in which ALPES TRIPS must return a sum of money to THE CLIENT, the return of the corresponding money will be made within 30 calendar days following: The day ALPES TRIPS communicates the cancellation of the trip and has all the bank information to make the transfer. 13. PRICE, DEPOSIT AND FINAL PAYMENT

 

Once the purchase request has been completed and sent by the CLIENT, the first payment made and accepted by ALPES TRIPS, the CLIENT will be obliged to pay the final price agreed for the particular service selected or the price sent by ALPES TRIPS in the case of a trip tailored to the client, with an adjusted offer. The price of the service will be that which is confirmed by email to the CLIENT by ALPES TRIPS in the case of an adjusted offer, or the one that appears published on the ALPES TRIPS website for standard offers. The percentage of the payment that constitutes the deposit, entitles the CLIENT to have their quota in the service respected and will be considered as an advance payment of the same. The payment of the balance must be paid in one or more installments according to the conditions defined in the selected offer. ALPES TRIPS reserves the right to cancel the reservation and charge a fine equivalent to the deposit, in the event that the CLIENT does not make one or more payments in a timely manner. In the case of standard offers, the prices displayed on the page are for mere reference, so they may vary if ALPES TRIPS so requires in order to meet the needs of the CLIENT, all of which will be done with prior notice. In all the cases raised, the total payment of the SERVICE must always be canceled before the TRIP begins, unless ALPES TRIPS has expressly agreed a different term with the CLIENT.

 

14. INCLUSIONS IN PRICES OF SERVICES

 

The price paid by THE CLIENT to ALPES TRIPS by virtue of the selected services, will comprise solely and exclusively those activities expressly related in the standard and / or adjusted offer, effectively accepted by ALPES TRIPS, as well as all those complementary services that are reasonably required for its effective execution under the service standards of ALPES TRIPS. Additional services not specified in the "includes" or in communications with ALPES TRIPS are not understood to be included and THE CLIENT must assume them.

 

15. INCLUSION OF VEHICLES AND / OR EQUIPMENT IN THE SERVICES

 

Unless otherwise indicated in the accepted offer, it will be understood that the price includes the cost of renting any specialized equipment, including vehicles and / or equipment that is required by THE CLIENT for the contracted trip. The price of the service may vary according to the type of vehicle and / or equipment required to participate in it. In case of contracting a service that requires a vehicle and / or equipment that needs a license for its operation, the CLIENT must have a valid license for the type of vehicle and / or activity to drive it; which must be valid and homologated in Germany. ALPES TRIPS may refuse to allow the CLIENT to enjoy the contracted trip if it does not carry the applicable license, proceeding to cancel the service for that CLIENT, without being responsible for the costs derived from that cancellation, and without being obliged to refund any portion of the price paid. The vehicles and / or equipment used during the trips may vary. The photographs of the vehicles and / or equipment published may differ from those that will be delivered to the CLIENT while maintaining their usefulness. At the time of delivery of the vehicle and / or equipment, THE CLIENT must constitute a coverage deposit equivalent to the deductible of the vehicle and / or equipment insurance, if any, on which a voucher will be issued by ALPES TRIPS where ALPES TRIPS reserves the right to adjust the amount of the deposit contained in the voucher as well as the deductible without prior notice. This deposit will be refunded when the vehicle or equipment is returned in the same condition it was delivered. In the event that a vehicle and / or equipment required for the CUSTOMER's participation in the service is damaged due to causes beyond ALPES TRIPS, it will do its best to replace it. However, if said vehicle and / or equipment cannot be replaced, it will be understood that ALPES TRIPS will not be obliged to replace it. In the event that THE CLIENT cannot continue using the vehicle and / or equipment during the service, it must inform ALPES TRIPS of this situation, and THE CLIENT must bear all the costs derived from the transport of the vehicle and / or equipment.

16. VEHICLE AND / OR OWN EQUIPMENT

 

THE CUSTOMER may access the services offered by ALPES TRIPS with a vehicle and / or equipment owned by it as stated in the purchase order, as long as it meets all the requirements established for the vehicles and / or equipment rented in the tours offered. In the same way, THE CLIENT who participates in any of the trips will be obliged to comply with all the obligations established in these TERMS AND CONDITIONS except that corresponding to the payment of the cost of the vehicle and / or equipment rental. ALPES TRIPS will not be responsible for damage or theft of said vehicles and / or equipment or for accidents suffered by THE CLIENT through the use of them during travel. ALPES TRIPS will presume that the equipment and vehicles owned or owned by the clients have undergone preventive and corrective maintenance in the appropriate periods according to the manufacturer's manuals. In the event that the equipment and / or vehicles have not undergone periodic reviews or adjustments, the equipment may not be used during the service. In the event that non-certified or properly maintained equipment is used and damage is generated as a result, the responsibility that arises will be in charge of the CLIENT.

 

17. CUSTOMER LODGING

 

The CUSTOMER's accommodation will be made depending on his preference as indicated in the service order. However, ALPES TRIPS will do its best to provide the CLIENT with the required accommodation, subject to availability and the order in which the reservation has been made within the service. In the event that a CUSTOMER wants a specific accommodation, and it is not available, he must assume the additional costs that may arise, without this being the responsibility of ALPES TRIPS.

 

18. EXCLUSIONS FROM THE PRICE

 

Those aspects that are not expressly included in the standard offer that appear in what the trip includes within the Internet page WWW.ALPESTRIPS.COM or that adjusted offer that is accepted by ALPES TRIPS and will not be included in the price of the services. that has been sent to the CLIENT. Nor will it include personal supplies, personal travel expenses, traffic fines, vehicle rental and / or equipment other than those provided within the trip, among others.

 

19. LUGGAGE

 

ALPES TRIPS will not be responsible at any time for the loss of luggage or any personal effects of the CLIENT and / or the companion of him if it is the case. It is recommended to establish a policy to insure luggage. The maximum amount of luggage allowed per CLIENT will vary according to the trip.

 

20. OWNERSHIP OF THE MULTIMEDIA MATERIAL

 

The photographs, videos, as well as any other material produced by ALPES TRIPS or its representatives are the property of the latter only, as are the economic and moral rights over it. ALPES TRIPS may use said material for any purpose, at its discretion, without limitation and without the duty of having permission from the clients that appear in the material.

 

21. METHOD OF PAYMENT

 

Payments made to ALPES TRIPS must be made through the means of payment enabled on the website or through the means specified by ALPES TRIPS to the CLIENT.

 

22. VALID DOCUMENTATION REQUIRED

 

ALPES TRIPS assumes that THE CLIENT is aware and knows of the fact that to make the trip and taking into account the requirements of ALPES TRIPS, it must have the required documents, such as visa, vaccines, certificates, among others. ALPES TRIPS expressly declares that the CLIENT will be solely responsible for complying with the presentation of the documents required by him at any time, as well as for the consequences caused by any related breach.

23. LIABILITY

 

ALPES TRIPS will be responsible for providing the services offered on its website or those agreed between it and the CLIENT, limiting its scope to the one published on its website at the time of improvement. ALPES TRIPS will not be liable in the event that these conditions should be modified without prior notice by ALPES TRIPS in the event of force majeure or unforeseeable circumstances. THE CLIENT will be liable to ALPES TRIPS for the payment of the price of the service that he chooses, as well as for all damages caused during the same to third parties, those that may affect his good name and commercial reputation, for damages and personal injuries or death that suffers during the service whenever they result from efficient causes beyond ALPES TRIPS, for those traffic accidents and damages to third parties that occur as a result of the services taken as long as they do not come from force majeure, fortuitous event or fault of the victim. THE CLIENT accepts that he will be liable exclusively for the payment of all damages and / or losses caused to himself, his relatives, his heirs, third parties and in general to any person during the validity and execution of these TERMS AND CONDITIONS, releasing ALPES TRIPS from the duty of vigilance that THE CLIENT has with his dependents or those responsible for the minor who participates in any of the trips. ALPES TRIPS will not be responsible for any damage suffered by vehicles and / or equipment due to their normal use and deterioration, as well as for defects in them, whether factory-made or not, which will exempt it from making refunds or compensation to the CLIENT, without damage that must replace that vehicle and / or equipment whose operation is limited by one of similar characteristics. ALPES TRIPS will not ensure the security of the luggage or any personal effects of the CLIENT and / or his companions. ALPES TRIPS will not be responsible for any delay in the delivery of the vehicle and / or equipment to the CLIENT, when it is caused by reasons beyond his control. ALPES TRIPS will only be responsible for those acts derived from fraud and / or gross negligence.

24. ALPES TRIPS AS INTERMEDIARY MARKETER

 

Whenever ALPES TRIPS acts before the CLIENT as a marketer of a service operated by an affiliated third party, the latter will be liable towards the CLIENT: to guarantee the existence and provision of the service based on the information previously provided on its website, in accordance with its standards or the information provided to ALPES TRIPS; to transmit to the CLIENT, in a clear, concise and complete manner, the relevant information so that he knows the characteristics of the service (s) to be operated by the third-party provider and on which ALPES TRIPS presumes its veracity ; Receive and process any complaint or claim that THE CLIENT presents towards the affiliated third party; to transmit to the CLIENT, in a clear, concise and complete manner, the relevant information so that he knows the characteristics of the service (s) he wishes to acquire; remain available to the CLIENT to attend and resolve any doubt or inconvenience that may arise related to the provision of the service and prior to the signing of the contract between the latter and the affiliated third party; provide permanent support to the CLIENT, through suitable means, providing advice related to the services of third party affiliates until the time of signing the contract; ensure that the signing of the contract or binding agreement between THE CLIENT and the affiliated third party is carried out; guarantee the good condition and operation of the equipment used, such as, but not understood as the only ones: airplanes, light aircraft, buses, vans, land transport, bicycles, motorcycles, boats, boats, among others. In addition, ALPES TRIPS will not be responsible for any falsehood or inaccuracy in the information provided by the third party provider or for any incident of any kind that occurs under the contract or that is directly or indirectly related to the execution of the same. If ALPES TRIPS were to accompany the CLIENT to any of the services provided by the third party provider, this will not be considered an assumption of responsibility under any circumstances. Based on the foregoing, it is understood that THE CLIENT already accepts the resignation that ALPES TRIPS expressly makes in the terms described above. THE CLIENT will be responsible for informing ALPES TRIPS in a timely manner and in writing of any incident, complaint or suggestion that arises around the third-party provider. In the event that ALPES TRIPS acts as a commercial agent for the products of third party providers of travel and adventure travel services, it will be liable to the CLIENT: to inform about the existence and characteristics of the service (s) offered by the third party provider based on the information previously provided by it to ALPES TRIPS and on which ALPES TRIPS presumes its veracity; To put in contact with the third party supplier and the interested CLIENT; to transmit to the CLIENT, in a clear, concise and complete manner, the additional information that the CLIENT may require about the service provided by the third party provider; to keep the CLIENT and the third party provider informed of any situation that could affect the signing of the contract or its correct execution; to solve the CLIENT any doubt that with his knowledge he could solve in relation to the products of third-party providers; to provide their collaboration to carry out the signing of the contract or binding agreement between THE CLIENT and the third party provider.

25. RISK

 

THE CLIENT is aware of the risks and consequences of participating in the activities offered by ALPES TRIPS. That in addition to the existing risks, some of the activities that will be carried out during the trip may be high risk, which contemplates certain risks of suffering damages such as, but not limited to: physical, mental or cognitive damages caused by conditions adverse weather conditions, development of the activity offered at high altitudes, traffic rules, heavy traffic or not, conditions of the routes or roads that need to be taken, among others. Likewise, there may be risks derived from the remote location in which the service is carried out and that prevent timely medical assistance and other benefits to which there is access in populated places, situations of insecurity, theft, robbery, among others, may also arise.

 

26. AIR OR GROUND TRANSPORTATION CONTRACTED BY ALPES TRIPS

 

In ALPES TRIPS trips that include the contracting by ALPES TRIPS of air or land transportation (both to get to the starting point and transportation during the trip), in which ALPES TRIPS acts as a simple intermediary between The CLIENT and the THIRD PARTY that provides the service, the CLIENT, when sending the reservation request, understands and accepts the risks to which he is exposed and understands that ALPES TRIPS will not be responsible for any damage caused to the CLIENT, derived from, between others, accident, personal injury, theft or any incident that occurs during the provision of said services. When ALPES TRIPS contracts an air ticket (on a commercial or private airline) it is understood as a simple intermediary between the service provider and THE CLIENT. Therefore, it is not responsible for the situations that may arise with the service (eg rescheduling, cancellation, postponement or any other change in the conditions of the flight), nor will it be responsible for additional expenses, for the non-presentation of THE CLIENT in the starting point or points of the activities, or for any damage derived from this service. It is recommended to establish cancellation policies. ALPES TRIPS will not be responsible for the loss of other services (both services provided by ALPES TRIPS and by a third party), lodging expenses, additional transportation or any other additional expense derived from cancellations, reprogramming, road closures, accident, delays or any other similar situation in air or land transport services included in the trip.

 

27. CHANGE OF THE CONDITIONS OF THE TRIP DUE TO WEATHER CONDITIONS, RISK FOR THE TRAVELERS OR ANY OTHER FACTOR OF CASE OR FORCE MAJEURE:

 

In the event that the weather conditions change or any other situation of Force Majeure or Fortuitous Event occurs that changes the conditions of the trip, the itinerary or prevents the completion of the trip, ALPES TRIPS may change the conditions of the trip, the itinerary may vary or You can re-plan the date of the trip. When possible and ALPES TRIPS decides, it will give the options to re-plan the trip or allow clients to leave the deposit for the value of the trip to use on any other trip, on a different date. ALPES TRIPS will not be obliged to make any refund and the cancellation policies already described will apply.

 

28. CLAIMS

 

All possible customer claims must be communicated to the ALPES TRIPS tour operator in writing (by email) within one month from the end of the trip stipulated in the contract. Once the deadline has expired, the traveler can only assert his rights if he has not been able to comply with it for reasons beyond his control. The limitation period for these claims begins on the day the trip ends as stipulated in the contract. If negotiations are pending between the traveler and the ALPES TRIPS tourist service provider regarding the claim or the circumstances justified by it, the prescription will be suspended until one of the parties to the negotiations refuses to continue the negotiations or delays them in a manner unjustified. The limitation period will not begin before three months have elapsed from the end of the suspension. Claims derived from illicit acts will prescribe within three years. The assignment of credits against the travel provider ALPES TRIPS is excluded.

29. PROVISION OF INFORMATION TO THIRD PARTIES

 

Information on the names of the participants in the trip and the whereabouts of travelers will not be provided to third parties, even in urgent cases, unless the traveler has expressly requested information. The costs derived from the transmission of urgent messages will be borne by the customer. Therefore, it is recommended that travelers inform their relatives of the exact address of their vacation (which can be obtained from the ALPES TRIPS travel agency) before starting their trip.

ALPES TRIPS is a German company. For this reason, German law and the jurisdiction of MUNICH are available for all claims.
